dsm-firmenich Takes Action Against Sclaréol Brevet in China

A Chinese court has been asked to order several entities to stop using a patented process for producing sclaréol, a chemical odorant found in the sage plant Salvia sclarea L.
dsm-firmenich, a manufacturer of food, aroma, and fragrance ingredients, has filed a patent infringement lawsuit in the Xiong'An district court in Hebei province, China, against several Chinese entities, including a sclaréol producer and a research institute.
The lawsuit concerns the unauthorized use of dsm-firmenich's patent for producing sclaréol through a biotechnological process.
Sclaréol is a highly used intermediate in perfumery, particularly in the production of amber notes such as Ambrox Super.
dsm-firmenich filed a patent for a biotechnological process to produce sclaréol in 2009.
The company is seeking a court order to stop the defendants from using the patented process and to compensate dsm-firmenich for the alleged patent infringement.
"As a global leader in innovation in perfumery and beauty, dsm-firmenich relies on a solid portfolio of proprietary technologies," said Amaury Roquette, executive vice president of the Perfumery & Beauty Ingredients division at dsm-firmenich.
"Our leading position in intellectual property, based on our patents and our in-depth expertise in sclaréol and its derivatives, allows us to ensure our clients' continuous access to our innovations, quality, and expertise in amber-scented fragrance ingredients."
"Given the solidity of our intellectual property rights on sclaréol and its derivatives, we remain determined to take all necessary legal actions to ensure respect for the company's exclusive patents, as well as the protection of our investments, innovations, and clients worldwide," he added.
